NATURAL JUSTICE TO TEACH JUDICIARY A LESSON: CONSEQUENCE OF TOLERATING THE MALICIOUS MISRA-GOGOI MALFEASANCE

The wrongful interpretation is an act based on deliberate intention. Justices, that too, in the Supreme Court, are not individuals who could fall for semantics. Despite knowing that reservation is for proportional representation and the nation is yet to have a caste census done, they are enforcing intra-category segregation. Wealth does not change caste identities or associated segregation. Despite full knowledge of this, Justices of the Supreme Court are enforcing creamy layer concept. Letting go of the the injustices from Misra and Gogoi has brought the nation to this point now.
The Justices who openly act against the citizens welfare and natural justice get to live a full life and access natural death.
They also get compensated with positions of power.
The reverse not happening is the root cause for this deliberate misinterpretation of the constitution.
They are playing in sync with the hindutva propaganda. They are leveraging their discretionary powers for unfair personal motives which renders them unfit to be part of the judiciary.
There will be consequences. When the law doesn't hold the justices accountable, something else will.
It is imperative at this juncture to better understand the motive behind the term - CREAMY LAYER.
The purpose of the term is to create, maintain and expand the Dalit-OBC divide in the country. That purpose has its roots in the hindutva propaganda. CREAMY LAYER is a mere term introduced in the legal lingo to deactivate reservation. The heuristics behind this, however, is that of the caste superiority complex that is being neglected by the natives of this land. That caste superiority complex is demonstrated by the descendants of the Aryan migrants in our country.

The preacher says if you quarrel with or argue against a brahman, remember, the brahman will not fight you but will make you fight such a power that 7 generations after you will perish in that fight. Brahman does not fight but he will make you fight others.
Now, the descendants of the Aryan migrants will say that there is no such thing as Aryans. This is a common right wing rebuttal in the South. In the North, for many years they have been claiming the Aryan identity blending it with the lie that they are natives of this land. A native of any land will never have to claim his/her nativity. The migrants alone have to claim nativity as that is their means to seep into the society they have now migrated into.

Now, coming back to the point of the Aryan migrants and their descendants wanting to rule over the natives, they clearly have been playing the dive-and-rule card all along. The Dalit and OBC classification themselves are proof of this. These identities wouldn't have evolved if the Aryan varnavyavastha had not been implemented in our society.
Dalits and OBC's have their respective identities because of the landless Aryans who migrated to our lands. It is their Aryan religious philosophy that has built the social construct where the real natives of the land have been segregated. The segregation has caused an intra-native rivalry and reservation, which by design aims to deactivate the Aryan segmentation and unite the natives through equitable access to opportunities via proportional representation.
The current descendants of the Aryan migrants therefore, spin the definition of reservation and create contempt within the natives leveraging the OBC/Dalit identities in the name of god. All they are aiming for is to maintain the state of OBC mentality that they are losing opportunities to the Dalits. They also repackage the same fake news to promote the idea of denying reservation for some as a means for the others to gain the same.
When someone misses out on critical early education and skip out of school, reserving college seats and executive jobs for them will remain insignificant. Implementing reservation needs careful planning to bring in the excluded groups within all categories. Denying others reservation has nothing to do with bringing in those who are left out.
The descendants of the Aryan migrants will not let the natives realize this. The sustainable solution begins with the campaign on the reservation system explaining its benefits and how it aims to enable all the natives come out of the Aryan social construct.
The habit of believing in god and choosing to stay away from critiquing the Aryan social construct is the only problem. Once the natives of this country acknowledge it, the rest will fall in place.
Humans evolved. Their need for communication evolved leading to the natural evolution of languages. Once the humans started coding their messages for passive communication, they noticed the opportunity to create using their respective coded languages. This evolved as an art form and many pieces of creative compositions were published. Some became so popular that masses started following them, revering the prime characters as their gods. This is the fact behind any religious scripture. We were here. Religion and caste came to us through our own creative compositions such as shastra/vedas etc. Nobody created us. We created the imaginary characters. the imaginary characters stand as the authority symbol of castes in our society. We need to get what was taken away on the basis of caste and therefore the same caste is the reference for it. Remember brahman is brahman in varna and caste. Everyone has a different caste identity being clubbed under other varna titles. It is not impossible to identify the culprit here.
When shastra is the source of our problems, we have use the same shastra to solve them as well. One term appropriately used in the mandates given in the shastra, stands as the harbinger of the ultimate sustainable solution - brahmahathya.

RESERVATION A CRITICAL VARIABLE IN THE SAFFRON RIOT SCHEMES: SCALING UP AND DEPLOYMENT OF THE MANIPUR MODEL

The recent supreme court ruling ordering creamy layer to be removed from quota benefits is a classic saffron move to incite riots across the nation. The economic clauses to prevent the wealthy from utilizing benefits are already in force and still this ruling has come out. The ruling having an additional point in favor of reservation is being used to label the entire ruling as positive but the reality is that it is a cake laced with poison. The cake is beneficial but the poison will kill.
The citizens do not seem to understand the underlying saffron riot scheme. They will not realize until the hindutva propaganda uses reservation-oriented controversies to polarize the society resulting in riots.
Anything that does not fit the natural justice definition cannot qualify for social justice. Special reservation is not the issue but how and from where it is unfairly segregated is the point of contention.
The crowd is assuming this has a binary view (pro and anti-reservation). The disagreement is on the 'how and where' and not the 'what'. The 'what' in fact needs to be expanded using a caste census for proper proportional representation.
This state of reservation-oriented political polarization varies from state to state in this country. The saffron terrorists are playing their ace to create the crisis for the entire nation to face. The hindutva terrorists are losing ground in the parliament and this is a do-or-die situation for them. The states have to be extra careful now.
For example, Tamilnadu already has the saffron gangsters roaming around in the guise of statewide campaigns. This means they have already mapped the vulnerable spots where Dalits are heavily outnumbered. Now, they must be operating to polarize the non-dalit crowd in those regions. These reservation controversies are their catalysts. They will force the Dalit crowd to protest in favor of reservation and incite the non-Dalit crowd to demand their reservation using a 'If-we-don't-get-nobody-should-get' rhetoric (The 10.5% claim is very closely placed for this). When both sides are at the height of their emotions, saffron proxies will incite violence in crowded environments prompting targeted retaliatory mob-violence.
Their template operates in two ways:
1. Non-dalit uprising on reservation issue -- Dalit Counter Protest -- Dalit-non-Dalit clash -- Retaliatory Violence targeting Dalit neighborhoods shortlisted by those in power (Manipur Model)
2. Dalits demanding rights/reservation -- Non-dalit demanding something similar -- proxy opposition to the protest by saffron gangsters -- Retaliatory Violence targeting Dalit neighborhoods shortlisted by saffron statewide-yatra groups (potential Tamilnadu model)
Raising awareness on how reservation works is critical in preventing these saffron riot schemes.
More critical is the need to stay away from every saffron terrorists and those who are even remotely connected to them.
The Dalits in BJP and connected with those in collaboration with BJP will be the first wave of victims. They will be used to widen the Dalit-Non-Dalit divide. Such is the risk for TN. Every state in this nation is approaching the same risk. Some are either boiling (like Manipur) or close to boiling.
Exercise caution. Stay away from saffron terrorists. Keep your kids away from the hindutva gangsters.
Reservation is not for establishing equality. It is for equitable access to opportunities through proportional representation and everyone competes within their respective categories.
If you are non-Dalit and you lose, you do not lose the opportunity to a Dalit. Someone within your own category has scored more than you.

What's Wrong With Tamilnadu and How It Can be Rectified: A Tamil's View

Have a look at the image above which displays the twitter post of Social Rights Activist Shalin Maria Lawrence. What she points out is the state of affairs in Tamilnadu on the socio-political front. That is exactly the problem that needs to be solved for the welfare of everyone. We live or die together. Safety is reliable only when it remains a shared resource. Tamilnadu should step away from religious/caste identities. We all are someone by our native language and that is our naturally acquired political identity. Every other identity is manmade and with limited utility imposing unfair collateral damage on everyone involved.
We can become someone by following a certain worship practice/faith. We can become someone by branding ourselves using any other trivial nomenclature. These are identities we either choose or get thrust down our throats and every time an identify is thrust on us, it almost always has a religious background to it.
We evolved and our languages evolved naturally to help us communicate with each other. When we realized we cannot rely on face-to-face active communication alone, we evolved passive communication through coding our naturally evolved languages. This led to us documenting our thoughts for others to receive. Passive communication means through written format opened the door for creative compositions and we composed a lot of creative works mirroring our thoughts and imaginations. Some of those compositions became popular over time and the mass acceptance made those compositions religious texts and their prime characters as the gods. The cascading effect of this specific line of creative compositions leveraging passive communication formats of naturally evolved languages led to many sacred texts and gods across the world.
We evolved. Our languages evolved. We wrote stories and chose a select few as favorites. This is how we have the religions and gods of today. They are, in every sense of the phrase, a figment of our imagination.
Anything we do on the basis of a figment of our imagination will remain trivial as it is not real. Religions are manmade imaginary concepts with no utility other than using them as reference to pick one over the other enabling a conflict which, is inherently never-ending. Any sub-categorization under a religion are nothing more than an imaginary doubling down on the already excessive triviality with the only consequence being baseless social segregation.
Language is the only real basis for political identity. if we cannot consider our own beyond the realms of religion and caste, we are incapable of considering others as our equals. When we remain in such state of abstract incompatibility with the society we are a part of, we are nothing more than an automated tool of segregation that religious/caste nomenclatures perpetuate.
When we act as the means of segregation through our affinity towards religions and caste, the society is put under an unfair social order devoid of equality. While detesting manmade identities can alleviate social segregation, the honor system nature of the act, at a societal level, remains non-unanimous in nature. The means to equality in this circumstance imposes the need for a sustainable preventive measure leveraging the very means of segregation which invariably turns out to be the concept of equitable access which manifests itself in affirmative action.
Equitable access is the means to social equality and the element of equitability must leverage the very basis of segregation for that is the only sustainable means to permanently deactivate the basis for segregation in our society.
If we cannot love our own looking over the religious and caste identities, we remain the victim of the world's oldest and largest conspiracy - religion.
Looking for a higher position while subscribing to an inhuman ranking system based on religion is nothing less than accepting to be a slave. The need to impose on others in response to one's acceptance of an existing hegemony is a clinical symptom of social tyranny. This will only perpetuate mass hysteria resulting in social collapse. The Aryan concept of social order is a classic example of this. The Dravidian concept of social uprising, by definition had the necessary ingredients but failed to manifest in practice. No point in speaking the praise of a knife that was once the sharpest in the market. When slicing away triviality is the need, a knife that works is better. We in Tamilnadu, have relied on the manmade Dravidian blade for decades now. It is true that the Dravidian blade did cut a few slices for all. However, it evolved to cut specific slices only for the one's who directly held its handle and since then it has not only stopped caring for everyone but also lost its edge.
We in Tamilnadu have to move away from the Dravidian concept of politics. We have always had a natural blade with us in the form of Tamil. We chose to not use it as we put our trust on the Dravidian blade. In all fairness, it turned out to be a historical mistake. Now that we realize that the Dravidian knife is no longer serving all, we, in all sense of sanity, have to pick the natural blade we have always had but never used - Tamil Nationalism. Tamilnadu must be converted to a land that does not put Tamils at a disadvantage in any respect. Tamils must have a complete control of Tamilnadu and its public resources. This is the sustainable means to flush out the Dravidian-majoritarian bias hiding behind the very caste system that Dravidian politics claims to be fighting against. Everyone is welcome to live here in Tamilnadu. They have always been here and are welcome to continue but under Tamil Governance. Trusting Non-Tamils with political administration has led Tamilnadu to be subjugated by Anti-Tamil and Aryan social orders. Tamilnadu must end its reliance on Non-Tamils in political administration and eradicate every last neutrino of the Aryan socio-religious concept both in theory and practice. Since this is Tamilnadu, it naturally becomes the Tamils' responsibility to get this done. It is a work-in-progress but we are on it.
Dravidam will be killed and Tamil Nationalism will prevail.
Such is the state of future outlook for Tamilnadu.

Buddha and Education Can Wait For Now; Dalits Need to Set Things in Order.
While atrocities against Dalits have remained a persistent anti-social evil, the trend has been amplified by the hindutva politics since 2014. Pushing the Dalits down the socio-economic ladder and not letting the future generations access the ladder is the agenda in play right now in India. Anyone resisting this in any way are dealt with violence and that has further evolved into an approach of setting up examples (of violent backlash) to coerce the Dalits in India to believe, their safety depends upon them keeping their heads down and doing what the dominant groups task them with.
This is varnavyavastha putting people in their place as prescribed by the shastras. Unless, we openly accept the need for anti-shastra/anti-hindutva propaganda, we will never ever control (never mind prevent) such police excess claiming innocent lives. Killing is merely a means to achieve the subservience they feel they've lost in the past few decades. Those who are yet to see proper roads and electricity are being sent further backwards in time.
Getting educated and believing in buddha has absolutely nothing to do with saving these lives or preventing such crimes. The education and buddha rhetoric is a mere tool for those who crave a Tier-II career in electoral politics.
Within the urban landscape where there is limited to no threat-to-life, the upliftment and subsequent representation in the mainstream can be enabled through education. When physical safety is confirmed and the worst adversary tones down to mockery/insults based on vedic beliefs, the rhetoric based on buddhism can help win a few arguments at best. However, this only applies to those who do not face life-threatening existential crises on daily basis like the Adivasis. Self-respect is important but only for those who have no fear of death or hunger.
The migration-to-buddhism and get-educated rhetoric does not fit the oppressed in rural societies. That rhetoric's existence is the check-post preventing proper life-saving retaliations.
Most oppressed people in the rural pockets hardly ever visit brahmin-controlled temples and tend to have their own worship practices. Moving to buddhism means nothing to them.
Going to school and getting educated cannot contribute to their physical safety from extra-judicial killings and related atrocities. It is the other way around where, once their safety is guaranteed, they will naturally aspire to get educated and grow.
Dropping their original identity is being thrust on them as the only way to integrate with the mainstream. The mainstream society has enough diversity already and it can very well accommodate Adivasis as they are. First and foremost is the assurance of safety where they gain confidence over their right to life and liberty which, as it turns out, is not a product of empathy but a promise of the constitution. When the constitution's promise is not upheld, the natural response has to be its outright rejection until the promises are upheld.
This is where the kalam-ki-kranthi pandemonium comes into play distorting the truth behind the retaliation, indirectly enabling the unfair labelling of proper responses as 'left-wing-terrorism' which has been created to dilute the only means to get to the negotiation table; all for a piece of political clout that can get them a Tier-II career in electoral politics.
The Dalits are facing impending genocide in almost every non-urban landscape possible in this country. Praying to a different god or getting a degree is not going to save them. It never has. It never will.
Remember, it is the same section of society which made it to the highest position possible through education and managed to compile the constitution which is getting massacred like undocumented guinea pigs in a research facility. All that highest level of education and the opportunity to compile the constitution has not installed any preventive measure to prevent atrocities against that section of society. It has, at best, managed to set standards for equality and equitable access to opportunities besides life, liberty and pursuit of happiness. To realize those standards, they need to be enforced. This calls for a political will that remains unhinged from the cravings of electoral politics. Such a political will has vanished from this nation's socio-political fabric decades ago. It needs to be revived. That is the only means to ensure the real moolnivasis live up to aspire for education and further economic upliftment. In between 'Living' and 'Aspiring to get educated' lies accessing proper roads, electricity and healthcare. 'Living' has become a challenge for Adivasis.
The need of the hour has changed.
We shouldn't be surprised about the consequences.
Buddha and education can wait for now.
